Welcome to Kanaa House!

Please read these Terms of Service ("Terms") carefully before using our website, mobile applications, and any services provided by Kanaa House LLC and its affiliates ("Kanaa House," "we," "us," or "our").

By accessing, using, viewing, transmitting, caching, storing, or otherwise utilizing our websites, mobile applications, services, or content (collectively, the "Applications"), you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to all Terms, please immediately discontinue use of the Applications.

We reserve the right to modify these Terms at any time without notice. Continued use of the Applications following any changes constitutes your acceptance of the updated Terms.

1. Use of the Applications

1.1 Eligibility

You may only use the Applications if you are at least 18 years of age and can form legally binding contracts under applicable law. The services of the Applications are not intended for minors.

You represent that any information you provide to Kanaa House is accurate and complete and that you will maintain and update such information as needed.

1.2 Legitimate Use

You agree to use the Applications solely to make legitimate reservations or purchases, and not for speculative, false, or fraudulent purposes.

Unauthorized use includes, but is not limited to:

  • Speculative or fraudulent reservations,
  • Attempts to circumvent system protections,
  • Scraping, copying, or data-mining activities without consent.

We reserve the right to cancel or modify reservations if unauthorized or improper activity is detected.

1.3 Prohibited Conduct

You agree not to:

  • Disrupt or interfere with the operation of the Applications,
  • Use automated systems (robots, spiders) without consent,
  • Introduce any viruses, worms, or harmful code,
  • Engage in unlawful, obscene, defamatory, or otherwise offensive behavior.
  • Violation of these provisions may result in immediate termination of your access.

2. Booked Properties

2.1 Limited License

Upon receiving written confirmation from Kanaa House, you are granted a limited, non-transferable license to occupy the specific unit for the confirmed dates and for personal, non-commercial use only.

You have no right to renewal, extension, or recurring use unless expressly agreed in writing by Kanaa House.

2.2 Communication

All operational inquiries, maintenance issues, or complaints must be directed to contact@kanaa.house. Guests must not contact property staff or third parties directly without permission.

3. Pets Policy

Pets are not allowed in Kanaa House properties unless expressly authorized in writing before arrival.

Violation of this policy will result in:

  • A penalty charge of up to USD $500 to your payment method,
  • Plus reimbursement of any additional cleaning, repair, or replacement costs resulting from the unauthorized pet’s presence.
  • Kanaa House reserves the right to immediately terminate your stay without refund in case of a violation.

4. Cancellation Policy

For information on cancellations, changes, or refunds, please refer to our Cancellation Policy.

5. Payment Authorization

By reserving through our Applications, you authorize Kanaa House to:

  • Charge your designated payment method for reservation fees, security deposits, service fees, and applicable taxes,
  • Pre-authorize your credit card prior to arrival,
  • Place a hold or charge for any Damaged Property Fee as described in Section 6.
  • Service fees charged by payment processors are your responsibility.

6. Damaged Property

  • You are responsible for leaving any property in the same condition as upon arrival.
  • If you, your guests, or your pets damage the property:
  • Kanaa House will provide notice and evidence of damage,
  • You will have two business days to respond,
  • Afterward, Kanaa House may charge your payment method the full amount of:
  • Lost revenue from property unavailability,
  • Actual or estimated costs for repairs, replacements, or additional services ("Damaged Property Fee").

We reserve the right to fix or replace damaged items and pursue reimbursement through your payment method or insurance policies.

7. Personal Items

Kanaa House is not responsible for loss or theft of your personal belongings during or after your stay.

Any personal items left after check-out may be removed, stored, or disposed of according to applicable law, and any costs will be charged to you.

We recommend securing renters’ or personal property insurance.

8. Content and Media Policy

Any photography or video taken inside Kanaa House properties must:

  • Credit Kanaa House when shared on social media (tagging required),
  • Receive prior written authorization for any commercial, advertising, or promotional use.

Violation of this policy will result in:

  • A fine of USD $100 per unauthorized photo or video,
  • Potential legal action for commercial misuse.

9. Accounts and Passwords

You are responsible for maintaining the confidentiality of your account credentials.

You must notify Kanaa House immediately of any unauthorized access or suspected breach.

You are financially responsible for all uses of your account.

10. Promotions

Promotions offered through Kanaa House are subject to specific terms and conditions.

We reserve the right to cancel or modify promotions at any time without notice.

11. Links to Third Party Websites

The Applications may contain links to external websites for your convenience.

Kanaa House is not responsible for third-party content, products, or services, and your use of such sites is at your own risk.

12. Disclaimers

The Applications are provided on an "as is" and "as available" basis without warranties of any kind.

Kanaa House disclaims all liability for:

  • Errors, interruptions, or inaccuracies,
  • Security breaches,
  • Loss of data, profit, or access.
  • Use of the Applications is at your own risk.

13. Indemnification

You agree to indemnify and hold harmless Kanaa House, its affiliates, officers, employees, and agents from any claims, damages, or expenses arising from your use of the Applications or your violation of these Terms.

14. Limitation of Liability

To the maximum extent permitted by law, Kanaa House shall not be liable for any indirect, incidental, consequential, or punitive damages.

In no event will Kanaa House’s total liability exceed the amount you paid for your reservation.

15. Severability

If any part of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.

16. Termination

We may terminate or suspend your access to the Applications immediately if you breach these Terms.

Upon termination, you must cease using the Applications and destroy any materials obtained.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Mexico City, Mexico.

Any disputes must be brought exclusively in the courts located in Mexico City, Mexico

18. Digital Signature

By using our Applications, you consent to electronically sign these Terms under the U.S. E-Sign Act and similar international laws.

19. Events, Productions, and Photo Sessions

All events, productions, or photo sessions at Kanaa House properties require prior written approval.

Unauthorized activities will result in a fine of USD $500 and may lead to legal action.
